In most cases a person is arrested for Vehicle Code Section 23152(a), driving under the influence of alcohol or drugs. If the police conduct a chemical test and determine that the driver's blood alcohol content (BAC) is over .08% by weight, then that person will also be charged with Vehicle Code Section 23152(b).

In most cases a DUI is preceded by a person being stopped by either a police officer or CHP officer stationed in the Los Angeles County. Often the officer will see the driver commit a moving violation. That will be grounds to make a stop of the vehicle. Most DUI cases occur when the driver is speeding, runs a red light, or fails to yield at a posted stop sign. That will be the reasonable suspicion that the officer needs to stop the driver.

The other manner in which a person is arrested for a DUI is when they enter a sobriety checkpoint. This called a DUI checkpoint. The police must comply with strict guidelines established by a California Supreme Court in the case of Ingersoll. If the driver is pulled over in the DUI checkpoint, then the officer will administer field sobriety tests in (FSTs). These tests are used to determine if the suspected DUI driver is under the influence of alcohol or drugs. If the person does not satisfactorily complete the tests then the officer will ask the driver to take a preliminary alcohol screening device (PAS Test). While the officer will want the driver to take this test, it is completely optional and need not be taken. But if the driver is arrested on suspicion of driving under the influence, then the person will have to take a DUI chemical test. There are two types of chemical tests. The driver will have to either take a breath test or a blood test.

These charges are usually misdemeanors. However if a person is injured by someone driving under the influence then the case can either be filed as a misdemeanor or a felony depending on the extent of the injuries. California Vehicle Code 23153(a) and 23153(b) has much more severe penalties.
